Competence
The Bureau of Telecommunications Regulation is established according to Regulamento Administrativo no. 5/2006, and starts to function on 15/05/2006.
The major responsibilities of the Bureau of Telecommunications Regulation are as follows:
- To regulate, supervise and promote the telecommunications and ensure the fair competition in the telecommunications sector;
- To promote the application of international conventions, agreements and other instruments in the telecommunications sector and represent the sector;
- To promote, participate and follow up the regional and international cooperation relationships in the fields of telecommunications and information technology;
- To promote the competitiveness of the telecommunications market and its healthy development;
- To safeguard the rights and interests of the telecommunications service users;
- To superintend the execution and observance of applicable legislations and regulations, including the legal access to the database of the public telecommunications service subscribers;
- To ensure the entire observance of the obligations defined in the operation licenses or in the concession contracts by the telecommunications operators;
- To provide opinions concerning the issuance or renewal of concessions, licenses or authorizations for establishing and operating telecommunications networks or for providing telecommunications services, except those for operating Internet gambling services;
- To analyze and provide opinions concerning the request of authorization for installing and operating the broadcasting, cable television and broadcasting satellite systems;
- To superintend the quality, pricing and tariff of the services provided by public telecommunications networks operators and public telecommunications services providers;
- To superintend the observance of the regime of telecommunications infrastructures installation in buildings and corresponding connections to the public telecommunications networks;
- To ensure the management and superintendence of the radio spectrum pursuant the applicable local and international regulations;
- To ensure the coordination and supervision of the radio services;
- To elaborate the general radio spectrum allocation chart, orbital position usage, numbering and other telecommunications resources plan, and submit them for superior appreciation and approval;
- To manage and promote efficient and reasonable usage of the telecommunications resources;
- To ensure the existence and availability of the universal telecommunications services;
- To define the technical standards of the telecommunications materials and equipments, and proceed with its standardization, ratification, type approval, superintendence and inspection;
- To settle, at the request of the parties involved, the conflicts of interest among telecommunications operators agilely and rapidly, according to the market development trends;
- To be responsible for issuance, renewal and acknowledgement of the radio-operator ’s licence;
- To promote, in collaboration with other public or private entities, the application of information technologies to enterprises and citizens;
- To present administrative punishment proposals to competent entities, with regard to the actions of violating law, regulations, licenses or contracts concerning telecommunications activities, practiced by network operators, service providers, other enterprises, institutions or natural persons;
- To execute administrative procedures and make decision concerning all the actions referred in the Administrative Regime of Radiocommunication Services, approved by the Decree-law no. 48/86/M, of November 3, under the condition that none of such administrative regimes were enacted explicitly in other forms;
- To accredit and superintend the certification entities, pursuant the regulations of the legal regime of electronic documents and signatures;
- To assist the Government in defining policies in the fields of telecommunications and information technology and proceed with the related studies;
- To issue normative directives to the network operators and service providers, in order to ensure the systematic development of telecommunications activities;
- To execute other responsibilities legally entrusted.
